The insurance company doesn’t "decide". They go with however much insurance was purchased. They pay out exactly who was named as beneficiary, exactly the percentage or dollar amount that the deceased told them to pay out.

We are getting the calls from the insurance agents to check with us. Could this be the beginning of identity theft? Our credit files are all frozen so no new accounts can be opened? Any ideas?

Yes, it could be ID theft. It could also be someone with a similar name that the agents got confused with your husband. I would file a police report of suspected fraud just to create a paper trail.

Note: Freezing your credit DOES NOT prevent opening new accounts. It prevents ACCESSING your credit report. There is nothing to prevent a creditor from opening an account without looking at your file. They just won’t be able to report the account on your credit report.
